Maritime, Shipping and Trade

 

Laracy & Co. advises the full range of parties involved in shipping and international trade: manufacturers and distributors, banks, commodities traders, cargo owners, ship owners, charterers, brokers, P & I Clubs, hull underwriters, average adjusters, freight forwarders, and cargo underwriters.

 

As a result, our expertise encompasses sale of goods disputes, charterparty disputes, cargo claims, personal injury and fatality disputes, and proceedings arising out of collisions, salvage and general average.

 

The firm also regularly advices banks and finance houses in relation to vessel arrests and ship mortgage enforcement. It advises unsecured creditors (including bond holders) regarding asset investigations and enforcement rights and processes, Winding Up proceedings, Mareva Injunctions and post Judgment remedies (Garnishee Proceedings, Writs of Fi Fa).

 

Damien Laracy initiated the first ever fleet sale “pendente lite” in Hong Kong on behalf of a syndicate of banks. He also represented a well-known United States military contractor in connection with proceedings in the High Court Admiralty List arising out of a collision that took place in New Orleans (with an arrest subsequently bring initialed in Hong Kong).

 

We often work with foreign lawyers in relation to PRC legal proceedings and cross border litigation generally.

 

The firm advises regarding enforcement of Judgments, Orders, and arbitration Awards in Hong Kong and in the PRC.
