On 12 November 2012, the Australian Competition and Consumer Commission (“ACCC“) released the first consultation paper on the Special Access Undertaking (“SAU“) lodged by NBN Co on 28 September 2012.

According to the ACCC, the SAU will be a major part of the framework which governs the price and other terms upon which NBN Co will supply services over its fibre, wireless and satellite networks to telecommunications companies.

The Consultation paper seeks views in relation to price and operational aspects of the SAU, as well as regulatory recourse commitments, such as whether the regulatory recourse commitments made by NBN Co provide certainty as to how it will comply with regulated terms made by the ACCC.

The consultation paper invites submissions on the SAU up until 11 January 2013 with the ACCC expecting to release a draft decision on the SAU in March 2013.
