On 17 October 2012, the Federal Attorney-General released a Discussion Paper entitled Australian Privacy Breach Notification. Release of the Discussion Paper is the latest in a series of initiatives undertaken by the government since the question of the adequacy of Australia’s privacy laws was initially referred to the Australian Law Reform Commission for consideration in 2006. The Discussion Paper, which invites comments by 23 November 2012, outlines the pros and cons of introducing a statutory obligation on private sector organisations – and perhaps government agencies – to report the occurrences of security breaches which potentially impact upon personal information stored by those entities.
