6 December, 2013

Legal News & Analysis – Asia Pacific – Australia – TMT

In November 2013, the office of the Australian Information Commissioner released Draft Guidelines in relation to Australian Privacy Principles 12 and 13. Previously, in October 2013, draft Guidelines have been issued in relation to APPs 1 to 11. APP 12 deals with access to personal information, and APP 13 deals with the collection of personal information, and the guidelines seek to clarify the relationship between the exercise of these rights under the Privacy Act and the exercise of similar rights under the Freedom of Information Act. The APPs will come into effect on 12 March 2014 when they replace the existing Information Privacy Principles (applicable to the Commonwealth public sector) and National Privacy Principles (applicable to the private sector).
