Herbert Smith has published the 2012 edition of the China investment guide. The guide aims to assist in successfully navigating China’s complex legal environment.
With the completion of a basic national socialist legal system being declared at the National People’s Congress in March 2011, recent changes to China’s foreign investment regime have been more incremental in nature. Changes reflected in the 2012 guide include:
- a new foreign investment industrial guidance catalogue
- new rules for Guangzhou and Shenzhen regional headquarters
- an expanded national security review regime (now in its own section of the guide)
- revised tax brackets and rates for individual income tax
- amended CIETAC Rules, which are now more in line with international practice
With these and various other changes throughout, the 2012 guide presents a concise overview of China’s rules relating to foreign direct investment, M&A, various other business transactions and dispute resolution.
