Our team of specialists regularly advise employees on their contractual and statutory rights in respect of termination, bonuses and discrimination. We are well-placed to deal with all possible employment issues, from the preparation and negotiation of the initial employment contract to dealing with problems during the employment relationship and ultimately to strategy and contractual rights upon exit. We frequently assist in resolving contentious employment issues quickly, quietly and if possible, without litigation.
We have acted for employees against large multi-national employers, including most of Hong Kong’s major banks and financial institutions. We frequently advise senior executives upon their exit packages and assist in negotiating their contracts for new roles. The firm has acted for employees in the High Court in matters involving complex bonus issues and unreasonable and constructive dismissal.
As well as acting for employees, we also act for employers in respect of all employment matters, including advising on rights and obligations on varying terms and conditions of employment, protecting confidential information, the enforcement of restrictive covenants and dealing with troublesome employees. Human Resources professionals also seek our advice on policy matters and how to handle internal disputes, whilst we keep them updated and well-informed on any legal developments that they should be aware of.
We are one of the few firms in Hong Kong that acts regularly for both employers and employees. We believe this gives us a special advantage, particularly in contentious matters, as we can understand and anticipate the strategy of the ‘other side’.
